Mediation is one of the best ways to resolve legal disputes efficiently and with less stress than going to court. At Sims & Purzer, Attorneys at Law PLLC, we guide our clients through the mediation process, ensuring their rights and interests are protected every step of the way. If you're heading into mediation, knowing what to expect can help you feel more prepared and confident.

1. Preparing for Mediation: Setting You Up for Success

Before mediation even begins, we’ll work with you to get a clear understanding of what you need and want from the process. A successful mediation isn’t just about reaching an agreement—it’s about making sure the agreement actually works for you. That’s why we:

  • Go over the key issues in your case.

  • Explain possible settlement options.

  • Gather the necessary documents and evidence.

  • Develop a strategy that keeps your best interests front and center.

A little preparation goes a long way, and we’ll make sure you’re ready to make the most of your mediation session.

2. Getting Started: The Mediation Session

Mediation usually begins with a quick introduction from the mediator, who will explain how the session will work. Mediation is meant to be cooperative, not confrontational, so the focus is on solutions rather than arguments.

Depending on the situation, both parties might sit in the same room, or the mediator may move between separate rooms. In virtual mediations, there are private breakout rooms where you and your attorney can discuss proposals before responding. Our job is to communicate with the mediator on your behalf, ensure your concerns are addressed, and keep negotiations moving in a fair and productive direction.

3. Negotiating: Finding Solutions That Work for You

This is where having an attorney makes all the difference. During mediation, we’ll:

  • Review and explain any settlement proposals.

  • Make sure nothing is overlooked that could cause problems down the road.

  • Ensure the terms are fair, enforceable, and in your best interest.

  • Help you avoid making any rushed or legally risky decisions.

Mediation moves quickly, and without legal guidance, it’s easy to agree to something that might not serve you long-term. We make sure everything is thoroughly reviewed before you commit to anything.

4. Reaching an Agreement: Making It Official

If mediation is successful, the terms will be put into a Mediated Settlement Agreement (MSA). Once signed, this document is legally binding—but it still needs to be turned into official legal orders before it can be enforced by the court.

Here’s where legal representation is essential:

  • Mediators can’t draft final court orders. That’s a job for an attorney.

  • We ensure that the final orders match exactly what was agreed upon.

  • We handle the court filings and formalities so everything is properly finalized.

While only one party technically needs an attorney for this step, it’s strongly recommended that both parties have independent legal counsel to ensure the agreement is fair and protects their rights.

5. What If Mediation Doesn’t Resolve Everything?

Not every mediation ends with a full agreement. If there are still unresolved issues, the mediator will document them, and the case may need to go to court for a judge to decide. However, even if mediation doesn’t settle everything, it usually helps narrow down the issues, making any remaining legal proceedings much more straightforward.

No matter what, we’ll continue to advocate for you and ensure your case is handled efficiently and effectively.
